1. Who we are

ProfitPilot is operated by Zak, the sole trader legal name of the seller (trading as "ProfitPilot"). References to "we", "us", "our" and "the Seller" in these Terms mean Zak. By accessing or using ProfitPilot (the "Service"), you are entering into a contract with Zak and agree to be bound by these Terms & Conditions. For contact and correspondence, please use the in-app support channel; a registered address will be provided on request where required by law.

2. Acceptance

By creating an account, subscribing, or continuing to use the Service, you agree to these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of an organisation, you confirm you have authority to bind it. Individual users must be of legal age in their jurisdiction.

3. The Service

ProfitPilot is a web-based pricing and profit calculator. You are granted a limited, non-exclusive, non-transferable right to use the Service within your selected plan.

4. Acceptable use

You must not misuse the Service, including: any unlawful use; fraud or spam; infringing intellectual property rights; interfering with security (malware, probing, scraping); reverse engineering; resale or redistribution; or circumventing technical limits. You are responsible for keeping your account credentials confidential and for all activity under your account, and for providing accurate information.

5. Intellectual property

The Seller retains all right, title and interest in and to the Service, including the software, documentation, and branding. No IP rights are transferred to you other than the limited licence to use the Service.

6. Payments, subscriptions, and billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically at the end of each billing period until cancelled.

7. Service level

The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends; account data may be exported for a reasonable period before deletion.

9. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is capped at the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profit, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation is prohibited by law.

10. Indemnity

You agree to indemnify the Seller against claims arising out of your content, your unlawful use of the Service, or your breach of these Terms.

11. Changes

We may update these Terms from time to time. Material changes will be communicated via the Service or by email.

12. Governing law

These Terms are governed by the laws of the Seller's jurisdiction. Disputes will be resolved in the competent courts of that jurisdiction, unless otherwise required by applicable consumer law.
